Terms and Conditions
These Terms and Conditions (the “Terms”) govern access to and use of FlyOrder. By using the Services or placing an order through FlyOrder, you agree to these Terms to the extent permitted by applicable law.
1. About FlyOrder
FlyOrder is a technology platform that enables users to view digital menus and submit orders to participating restaurants, cafés, hotels and other hospitality merchants through QR codes and other digital interfaces.
Unless expressly stated otherwise for a particular service, FlyOrder provides the technology that transmits and manages orders; the participating merchant is the supplier responsible for the food, beverage, accommodation-related service or other merchant product ordered by the user.
2. Eligibility and Acceptance
You must have legal capacity to enter into the relevant transaction or use the Services with any authorization required by law. If you do not accept these Terms, do not use FlyOrder.
3. Orders
Before confirming an order, you are responsible for reviewing the items, quantities, price, table/room/location information and any special instructions you submit.
An order is subject to merchant acceptance and availability. The merchant may reject or cancel an order where an item is unavailable, information is incorrect, payment fails, fraud is suspected, or another legitimate reason applies.
4. Merchant Responsibilities
Participating merchants are responsible for their menu content, item descriptions, prices, availability, food preparation, food safety, ingredients, allergen information they provide, quality, fulfilment, merchant licences and the service delivered to the customer, subject to applicable law.
FlyOrder remains responsible for obligations that apply directly to FlyOrder as the platform operator and does not exclude liability that cannot legally be excluded.
5. Prices, Taxes and Fees
The applicable price and any clearly disclosed taxes, service charges, delivery fees or other permitted charges will be shown before order confirmation where technically applicable. Menu prices are generally provided or approved by the participating merchant.
6. Payment
Depending on the merchant, payment may be made at the venue, in cash, by card, or through an integrated electronic payment service.
Where an independent payment provider processes the transaction, that provider's terms may also apply. Unless expressly disclosed otherwise, FlyOrder does not hold customer funds on behalf of merchants and does not store full payment-card credentials.
7. Cancellations
A cancellation request should be submitted as soon as possible. Cancellation may not be available after a merchant has accepted an order or begun preparation, except where cancellation or another remedy is required by applicable consumer law or the merchant's disclosed policy.
8. Refunds
Where a refund is due, it will be handled by the responsible merchant and/or applicable payment provider according to the transaction structure, payment method, merchant policy and mandatory consumer rights. Processing time may depend on the merchant, payment provider and issuing bank.
9. Allergies and Dietary Requirements
Customers with allergies, intolerances or specific dietary needs should check the merchant's information and, where necessary, communicate directly with the merchant before completing an order. Ingredient and allergen information displayed in the menu is generally supplied by the merchant.
10. Hotel and Room-Service Orders
For hotel use, the customer must ensure that the room number, guest details or other requested service information is correct. Hotel-specific policies, opening hours, room-service rules and charges may apply in addition to these Terms.
11. User Accounts and Security
If accounts are provided, you are responsible for protecting passwords, verification codes and access to your device. Notify FlyOrder promptly if you suspect unauthorized access.
12. Acceptable Use
You must not use FlyOrder to place fraudulent or abusive orders; interfere with the platform; attempt unauthorized access; introduce malicious code; impersonate another person for fraudulent purposes; scrape or exploit data unlawfully; or use FlyOrder in violation of applicable law.
13. Intellectual Property
The FlyOrder name, trademarks, logos, software, interface, database structure, design and platform content owned by FlyOrder or its licensors are protected by applicable intellectual-property laws. No right is granted to copy, modify, reverse-engineer, distribute or commercially exploit such materials except as expressly authorized.
14. Availability and Maintenance
FlyOrder aims to provide reliable access but does not guarantee uninterrupted service. Availability may be affected by maintenance, connectivity problems, merchant systems, third-party providers, cybersecurity events or circumstances beyond reasonable control.
15. Third-Party Services
The Services may integrate with third parties such as payment gateways, maps, messaging or external merchant systems. Independent third-party terms may apply to their services, and FlyOrder is not responsible for matters under their independent control except to the extent required by applicable law.
16. Complaints
For platform-related complaints, contact Support@flyorder.io. For food quality, fulfilment or merchant-service issues, FlyOrder may facilitate communication with the relevant merchant. Nothing in these Terms limits a consumer's right to approach the competent Consumer Protection Authority or other authority.
17. Limitation of Liability
To the maximum extent permitted by applicable law, FlyOrder is not liable for losses caused solely by matters under an independent merchant's control, such as food preparation, ingredients, merchant service or merchant fulfilment. FlyOrder does not exclude or restrict liability where exclusion or restriction is prohibited by law, including mandatory consumer rights.
18. Suspension and Termination
FlyOrder may restrict, suspend or terminate access where there is reasonable evidence of fraud, unlawful activity, platform abuse, security risk, repeated material breach, non-payment of applicable merchant fees, or regulatory concerns. Where appropriate, FlyOrder may provide notice or an opportunity to remedy the breach.
19. Changes to the Services or Terms
FlyOrder may update features or these Terms. The current version and effective date will be made available through the website or application. Where a change materially affects legal rights, notice will be provided where required by law.
20. Electronic Communications
You agree that order confirmations, service notices and other communications may be provided electronically where permitted by law. Electronic transactions and records are subject to the applicable laws of the Sultanate of Oman.
21. Privacy
Personal data is handled in accordance with the FlyOrder Privacy Policy and applicable Omani data-protection requirements.
22. Governing Law and Jurisdiction
These Terms are governed by the laws of the Sultanate of Oman. Disputes are subject to the competent courts or authorities in Oman, without prejudice to any mandatory consumer-protection or dispute-resolution rights.
23. General
If any provision is held invalid or unenforceable, the remaining provisions remain effective to the extent permitted by law. A failure to enforce a provision does not constitute a waiver. These Terms, together with applicable policies shown at checkout or within the Service, form the agreement governing use of FlyOrder.
